In certain cases of industrial disputes demand for payment of bonus was also
included. In 1950, the Full Bench of the Labour Appellate evolved a formula for
determination of bonus.
A plea was made to raise that formula in 1959. At the second and third meetings
of the Eighteenth Session of Standing Labour Committee (G. O.I.) held in New Delhi
in March/April 1960, it was agreed that a Commission be appointed to go into the
question of bonus and evolve suitable norms.
As per the Bare Act, the Bonus Act consists of 40 Sections and 4 Schedules. We
are going to present only some of the important ones……
Applicability – Section 1
(Rima)
Every factory (as def. in Factories Act)
Every other establishment in which 20 or more
persons (less than 20 but 10 or more if
appropriate Govt. notifies) are employed on any
day subject to certain exemptions.
Employees' drawing remuneration of Rs 3,500/-
or more and those who have worked for
less than 30 days are not eligible to receive
bonus under the Act.
Bonus to be paid within eight months from the
expiry of the accounting year.
Eligibility for bonus – Section
8 (Rima)
fraud; or
the employee has been on maternity leave with salary or wage, during
the accounting year.
Time-limit for payment of
bonus – Section 19 (Ekta)
All amounts payable to an employee by way of bonus under
this Act shall be paid in cash by his employer –
Provided that every such application shall be made within one year from the
date on which the money became due to the employee from the employer
Provided further that any such application may be entertained after the
expiry of the said period of one year, if the appropriate Government is
satisfied that the applicant had sufficient cause for not making the
application within the said period.
Penalty – Section 28 (Sadia)
if any person-
contravenes any of the provision of this Act or
any rule made thereunder, or
to whom a direction is given or a requisition is
made under this Act fails to comply with the
direction or requisition,
he shall be punishable with imprisonment for a
term which may extend to six months, or with
fine which may extend to one thousand
rupees, or with both.
