History of Abuse by Igor Malenko of Mila & Others May 2011

Video Clip of Igor Sucking Milas Fingers-Mila only days old. This is part of long DVD Igor spent all his time making after Milas birth. He sent to all my friends. They all threw it out (they told me later) except Margo who kept it and gave to L. Devoe when Devoe started her investigation.

Summary
DV arrest and recordon wife-child witnessed. 4 corroborated assaults on wife with infant in her armsnearly every-time while breastfeeding. Evidence in divorce hearingvideo where Igor is sucking Milas fingers. Experts are concerned about sex abuse. Dec 2008 UTI-red- inflamed vagina doc by 2 doctors with blood and skin cells in her urine with first disclosures of sex abuse. July 2009. Video taken by me of Mila telling her cat about the sex abuse. Spurwink said it was valid and credible. 2009 Baseball size red welt on her face-Poppa threw a ball at me in anger. Documented by SAFE Nurse and called into DHHS. Oct 2009 On-going disclosures to SAFE nurse and to Spurwink Sex Abuse Forensic Examiner. Spurwink ruled out coachingsaid disclosure credible. 2008-2009-2010. On-going rash on bottom, vaginitis ongoing since he got unsupervised custody. No history of rash or vagina problems before. This includes odor, vagina redness, yeast infections and rash. 2008-2010 56ng of Meth in her urine when running a date-rape panel after weekend visit with father and disclosure of father blowing wind in her face that makes her cough and sneeze. 2010 Large bruise on arm and half-inch cut next to vagina she says her father did bothbikini line cut with a box that he rubbed while she watched cartoons. 2010. Contusion to forehead March 2011 -father hit her with a pan because she was crying. Extreme weight loss of 6 pounds the 24 days he retained her. Lots of behavior problems as a resultincreasing. Fantasies about how to get away from her father, how to nail him to the floor, catch him with a net, scare him to a bad country, even once how to kill him, drawing pictures of what it looks like when he hits her, etc. Nightmares, not wanting to go on visits, reverting to infant state-wanting me to spoon feed her many meals, wanting to be held like a baby and nursing or suckling my shirt on my shoulder to comfort herself.

Timeline
May 2006-Lori and Igor marry. Lori is 4 months pregnant. September/October 2006-Igor has first violence against Lori-throwing a plate of hot food at her when she didnt come to the table at his command because she was on a call with a renter. November 2006-Mila is born and Igor threatens Lori in hospital room right after birthto slap her so hard she will never forget it. December 2006-Igor wont let Lori and Mila leave the house, except for doctors appointments, for 40 days after birth-claiming it is cultural thingwhat they do in Macedonia. Jan 2007-Igor is fired, after only 3 months, as part-time swimming coach at Portland YMCA because of aggressive behavior against another swimmer in front of the little children he was coaching. He said his favorite age was the little ones. March 2007-Igor nails Lori in the head (with Mila present )with a heavy jar because Lori wanted to hire a part-time nanny . Lori is working full-time from home for the UN and doing full-time child care. Igor is building his swimming school which meant staying in bed with his laptop working on his website. Domestic Assault of me and Mila witness. On Temporary Green Card. (2007) Arrest. Police record. 1 year court filing for assault.

Timeline
June/July 2008-Igor threatens to kill Lori in counseling sessions with David Prichard. Prichard does nothing and Lori stops the sessions. Mila was present for all because Igor wouldnt let her be anywhere else. August 2008-Igor threatens to snap Loris neck in three separate graphic rage attacks in Budapest where they have relocated for Lori to take a position as a professor at Central European University. Lori flees with Mila fearing for their lives back to Maine. Igor returns to Maine and promises to be employed and on medication. May 2009-Igor threatens to kill Lori, with Mila present. Lori files a protection order granted by Judge Kennedy. Igor is on supervised visits for 9 monthsLori ordered to pay for these. Igor pleas NOLO CONTENDERE to Domestic Abuse Protection Order for me and Mila. Domestic Abuse Protection Order for me and Mila upheld by Judge Kennedy when GAL tried to lift. On Temporary Green Card. (2009).

Timeline
January 2009-Judge is suddenly switched to Moskowitz, unexpectedly, and Moskowitz says there is no evidence of abuse by Igor to Mila and Lori and lifts the protection order and grants joint custody. Mila comes home with inflamed vagina, UTI, blood and skin cells in her urine saying her father is poking her gina with his penis. (July 2009). Spurwink confirms sex abuse. DHHS does nothing. PFA in Ellsworth granted. (Aug 2009) Oct. 2009-Moskowitz denies PFA. Visits start. Oct. 2009-Milas first visit come home with large abrasion on face. DHHS does nothing. Igor caught Shoplifting childrens cough syrup with Mila and lies to police. Arrest and guilty plea. (2010). Date Rape panel performed on Milas urine due to Igors shoplifting of childrens cough syrup. 56 ng of meth in Milas urine. DHHS does nothing.

Failure to pay child support. Temporary and Permanent Green Card. (20082010). Documented by DHHS and 2 court orders. Over $5,000 in back support making it a Federal Offense. DHHS refuses to enforce. July 2010-Mila comes home with deep bruise on arm and inch and half cut on her bikini line-saying her father rubbed a cardboard box there while she was watching cartoons. DHHS does nothing. March 2011-Mila comes home with large contusion on forehead saying her father hit her hard in the head with a metal pan because she was crying. DHHS does nothing. April 2001-DHHS case worker claims it was just Milas birthmark and there in no evidence of abuse. May 2011-Mila is returned to Lori after being retained by Igor for 24 days and tells Lori Poppa told me to say there was no bruise it was just my birthmark. April-May 2011-Mila lost 6 pounds in the 24 days her father retained her, in violation of the court order, saying her father is not feeding her. DHHS does nothing. 12 May 2011-Louise Boisvert at DHHS claims because Mila didnt disclose in a neutral setting about the panthere is no evidence of abuse. Boisvert says the weight loss was probably due to Mila throwing up. Boisvert says this is just a terrible custody problem where two parents cant get along and she hopes for that poor little girl I can learn to co-parent with Igor.

Subject: RE: Department Decision Dean, Since Beth provided Waxman with a copy of the video of Mila telling kitty, which HHS was not allowed to do, I am requesting that HHS extend a similar courtesy of providing me with copies of whatever documents and testimonies Waxman is using to attempt to influence HHSs decision. I can only assume he is trying (as he has been for over a year) to prove I am an unfit mother. By providing Waxman a copy of the kitty video, even before supervisors at HHS saw this, HHS allowed Waxman time to rebut and influence with his version of events. Thus, he has been allowed undue influence in your decision-making process. This combined with the knowledge that Waxman has been spending a great deal of time at HHS, is of concern to me. Michael Waxman has been very successful at intimidating and harassing people into his viewpoint; his harassment and behavior has crossed many legal/ethical boundaries, which is why the judge granted a hearing to disqualify him from the case. I would also like to know why, after Spurwink called to say this is happening, HHS has not immediately filed a PFA on Milas behalf? Milas doctor called and spoke with Beth yesterday, sharing her concerns, and Beth emphasized to Milas doctor that Igor is only on voluntary supervision and he could decide, at any time, not to have voluntary supervision. Why has HHS not yet taken steps to ensure this supervision is court-enforced and not voluntary?

Observing a pattern to a bruise, abrasion or a scar is a final characteristic that is extremely concerning for physical abuse. Head and neck cutaneous injuries, particularly involving the face, require careful evaluation since they are more common in children who have been abused and are rare in non-abused children. Use past behavior to predict future behavior. Without meaningful intervention, families experiencing domestic violence will continue the cycle of violent. The type of violence often remains the same.

PATIENT: MALENKO, MILA-DOB: 11/29/2006-DOS: 12/16/2009 I was asking what she does when she is with her dad on the weekends, Mila states that he "poked me in my gina". I said what did he do? Mila stated that he, "put his penis next to my gina". Then she stated You can't tell anyone. asked Mila how it makes her feel when he does this and makes me sad", "he has windows in his underwear". I asked what is the window for "to see outside" and I asked Mila where do you sleep when you are at your dad's and Mila answered, "in my own bed". I asked does he wake you up at night to poke you and Mila responded, "No, in the morning". I asked if anyone else was there at the time he was poking her, and she state "no, just my daddy. OBJECTIVE: Child looks well, sitting comfortably on the exam table. Mom was out of the room during that questioning. She is dressed appropriately. Has good eye contact. Weight is 31.8 pounds, and height 3 feet 3 inches tall. I did do a quick visual inspection of the vagina. There is no swelling, redness or bruising of the vagina or the anus. ASSESSMENT AND PLAN: Child's disclosure of sexual abuse. I did call Spurwink Clinic in Portland where they have interviewed Mila before and attempted to call DHS which was not open at the time of my call. I will contact them in the morning. The child did leave with the mother. Will try to arranged for evaluation prior to her next visit with her father this upcoming weekend.

7 January 2010 Mila Discloses to DelVecchio

Bill Harwood threatens to sue DHHS when DHHS cancels the promised meeting. Jim Beougher tells Bill the AG has ordered DHHS to cancel the meeting, not release the case file, and cease all communications. At the same time, suddenly DelVecchio drops Mila and me as patients. I was due for a pap smear she refused to see me. I was not told why we were being dropped and the office manager refused to let me speak with Angie. I was stunned because Angie had become a friend. She had even encouraged me to run with Mila because she believed she was being abused and DHHS would not protect her. The last time we saw Angie, she had a sea glass necklace on and Mila loves sea glass. When we got home Mila picked out a favorite piece of sea glass from her collection and mailed it to Angie. Dan Despard sends Harwood a DHHS report that claims DelVecchio told them she thinks Mila is not credible. DelVecchio issues an addendum she claims she forgot an entire conversation with Mila. Addendum is extremely suspicious.

In addendum DelVecchio suddenly uses Daddy when for all other reports she wrote what Mila calls her father, Poppa or Poppi. DelVecchio is suddenly surprise to hear Mila use the word penis. Mila has used it before, documented by DelVecchio December reports. DelVecchio who wasnt surprised then. She suddenly is now? DelVecchio had read Spurwink Report and discussed case with Polly Campbell. She knew Mila had used the word penis with Spurwink. Who asked DelVecchio to write this addendum? She states at the startshe was asked to write this. She wrote detailed, precise notes, during the exam as she always did and suddenly she forgot an entire conversation, one this important, after I left the office with a copy of the original hand-written exam record? This is the only DelVecchio medical record for which there is no original hand-written record. DelVecchio always took precise, careful notes during her exams with Mila. She would give me the hand-written exam report before I left the office. Later these would be typed by their staff. The addendum only exists in a typed form. It uses words Mila never used and DelVecchio never reported Mila using. If violates SAFE nurses protocol. She forgot an entire and radically different conversation with Mila and only remembered after I had left the office with the original hand-written medical exam?

Upon receipt of that information, one of our Child Protective Intake caseworkers contacted Angela Delvecchio, Family Nurse Practitioner with Cadillac Family Practice located at 322 Main Street in Bar Harbor, telephone number 288-5119, seeking further information. Ms. Delvecchio had previously contacted Child Protective Intake in December, after Mila Malenko made the statement, Daddy poked me in my gina. At that time, that report was reviewed and determined to be inappropriate for child protection assessment as it was the same information that had already been assessed and found to be unsubstantiated. The information you forwarded on 1/11/10 indicated that your client had again brought Mila to be examined by Ms. Delvecchio and Mila again made the same statements about Daddy poking her gina. Below is the CPI caseworkers documentation of the phone interview with Angela Delvecchio, FNP.

Despards Report. Note he begins with 16 December visits-ignoring totally Oct. reports.
Date/Time: 1/12/10 12:05pm Referent information: Call to the referent, Angela Delvecchio, Family Nurse Practitioner with Cadillac Family Practice located at 322 Main Street in Bar Harbor, telephone number 288-5119, seeking further information. The referent is Milas primary care physician. She began seeing Mila on 10/13/09. The referent has seen Mila three times, most recently on 1/7/10.

Presenting problem: The referent saw Mila on 12/16/09 for a follow up for a laceration to her thumb. During the visit, the referent was gathering information about Mila such as her routines, hobbies and relationships. Mila stated that she visits her father, Igor on weekends. The referent asked Mila what kinds of things she does with Igor, Mila stated "[he] poked me in my gina. The referent asked what did he do? Mila said "[he] put his penis next to my gina. Then she stated you cant tell anyone. The referent asked Mila how it made her feel when Igor did this and Mila stated mad and sad. He has windows in his underwear. The referent asked Mila what are the windows for? and Mila stated to see outside. The referent asked Mila where she sleeps when she is at Igors home and Mila stated in my own bed. The referent asked Mila if Igor wakes her up in the night to poke her and Mila stated no, in the morning. The referent asked Mila if anyone else is at the home when Igor pokes her and Mila stated no, just my daddy. At the time of Milas disclosure, she and the referent were alone in the examination room and Lori was waiting outside. The referent described Mila as appearing comfortable and making good eye contact throughout the visit (including during her disclosure, which the referent found strange). During the visit, the referent visually examined Milas genital area (vaginal and anal areas) and noted no swelling, redness or bruising. .

The referent spoke with Lori after speaking with Mila. Lori stated that this was not the first time that Mila had disclosed sexual abuse by Igor. The referent advised Lori that she would be making a report to the Department and she would contact The Spurwink Child Abuse Program as well. When the referent spoke with Dr. Ricci with The Spurwink Child Abuse Program, Dr. Ricci indicated that Mila was previously evaluated and that The Spurwink Child Abuse Program would not conduct another evaluation unless there was new information or unless Mila presented with physical signs of trauma. On Tuesday (1/5/10), Lori contacted the practice to report that Mila returned from a visit with Igor with a rash on her buttocks. The practice offered to have Mila seen by Dr. Mark Kandustch that same day. Lori told staff that she wanted Mila to be seen by the referent and took a later appointment on 1/7/10. The referent saw Mila on 1/7/10 for the rash on her buttocks. On that occasion, Lori brought Mila in and expressed concern that the rash may be indicative of sexual abuse. Lori stated that she knew the referent needed to meet with Mila alone and left the examination room.

After Lori left the room, Mila stated when I was at my poppis house he put his penis near my gina. The referent asked when this occurred and Mila stated last weekend. The referent asked Mila how the touching made her feel and Mila stated sad and mad. When asked about Milas demeanor on this occasion, the referent noted that again Mila did not appear distressed, rather she sat comfortably and made good eye contact. The referent states that she did not note in Milas record, but the referent did ask Mila some additional leading questions because of the oddness of her demeanor in light of her statements. The referent states that she asked Mila did he poke you with a crayon? to which Mila quickly responded yes. The referent asked did he poke you with a bowling ball? to which Mila quickly responded yes. During the visit, Mila presented with a mild rash on her buttocks, which the referent diagnosed as a contact dermatitis consistent with diaper rash. The referent recommended a low dose cortisone cream to treat the area. The referent did not note any other physical health issues or any signs of trauma to Milas genital area.

The referent states again spoke with Lori after examining Mila. The referent explained that she felt the rash was contact dermatitis consistent with diaper rash, and was not indicative of sexual abuse. In light of the situation, the referent did suggest that perhaps Lori seek counseling for Mila through the Behavioral Health Center. Lori told the referent that she can not seek counseling for Mila without Igors consent. Lori stated that Igor will not consent to counseling. The referent does not know if Lori means that she doesnt think Igor will consent or whether the issue has been brought up and Igor has actually refused to see Mila enrolled in counseling. Though the referent is reporting disclosures made to her by Mila, the referent is concerned with the credibility of Milas disclosures due to her demeanor during the disclosures. The referent specifically stated that she found it odd that Mila did not appear at all upset while making such statements and that Mila didnt act like it was a secret even when telling the referent not to tell anyone about the disclosures. The referent states that Lori has told her that there is a bitter and contentious divorce proceeding underway. The referent states that Lori spoke about the issue in some detail. As you can see from the information gathered in this interview, Angela Delvecchio, FNP has stated that the rash your client believed was indicative of sexual abuse, was in fact, diaper rash. Further, Ms. Delvecchio is concerned about the credibility of Milas statements, both because of her demeanor while making the statements, as well as her responses to simple suggestibility testing (e.g. Did he poke you with a bowling ball?). Based on Ms. Delvecchios conclusions and that the childs statements are the same as have already been assessed as unsubstantiated, Child Protective Services will not be assigning this report for a new assessment

I am giving you absolutely no consent to do this to Mila. If you do this unilaterally, I will do everything I can legaly to hold you responsible for your actions towards Mila. I will suggest that you get your self in a suitable therapy for your condition asap. Stop using Mila as a toy to obtain your selfish goals! I will not accept it. It is an emotional abuse what you do to Mila and I will do everything to prevent my child suffer from your delusions. I will make sure that this latest action goes on record.

Mila is a happy, well adjusted, bright and wonderful person. She has the greatest time in her life and is very happy when with me. I have not heard anything else from her school, from her previous schools or her doctors. My observations and the ones from the people around me are consistent with what I just said. I will get plenty of testimonies in writing.
I am asking you to refrain from bringing Mila to any kind of therapy. I am not giving you any consent to do that. Especially since you cant even explain why. I need the name of her doctor that you consulted with and their number! I need you to provide it immediately. I will contact them my self and discuss this action of yours.

HANDRAHAN IS NOT AUTHORIZED TO BRING MILA FOR ANY KIND OF MENTAL HEALTH EXAMINATION OR TREATMENT. I find this especially troubling when Ms. Handrahan is unwilling to explain what behaviors make her believe that Mila needs therapy. You know as well as I do, that therapy itself can be traumatic, and is not generally recommended unless the child is exhibiting certain red flags. Are there any red flags? If so, what are they? And, let me be more clear -- even if Mila would benefit from therapy, we are NOT agreeing to have her see a therapist in the Ellsworth area, since we do NOT agree that she is authorized to relocate there in the first place. There is a very good child therapist in Portland named Ken Raffel, whom we could use if Ms. Handrahan and Igor agree that there is a real need for therapy. If Ms. Handrahan is truly trying to do something to promote the best interest of her child, then she will gladly explain what problems/concerns generated this notion that Mila needs therapy. If she/you can't or won't articulate that simple information, then we shall assume that her need/desire to have Mila in therapy has nothing to do with Mila, and everything to do with Ms. Handrahan's selfish schemes. EMERGENCY ROOM REPORT CHIEF COMPLAINT: This 3-year-7-month-old child is
here for bruises and scrapes. HISTORY OF PRESENT ILLNESS: Mila returned from a visit with her father Sunday evening. Mother noted that the child had a bruise on her left arm and a scrape on her proximal left thigh. She contacted her physician the following morning, who advised that she come in and be seen, but Mila did not want to come and mother deferred to her wishes. She brought the child to the emergency room the following morning, which is today. When mother asked the child to show me her boo-boos, the child shows me 2 lesions. The first of these is a bruise on her left upper arm, it is about 1.5-cm in diameter, brownish in color. When asked how this happened, Mila replies, "papa grabbed my arm." I then asked her, "why did papa grab your arm," and she stated, "I was starting to run in the road and papa grabbed me here." The second lesion she showed me was a 2.5- to 3-cm long linear scrape at the junction of her left medial thigh and labia majora. There are 2 more superficial scrapes parallel and adjacent to this. When asked how this occurred, she replied, "papa rubbed a box there." When I asked, "how did that happen," she stated, "I was watching Blue's Clues (a cartoon show) and papa punched me with a box." When I asked what kind of box, she stated, a cardboard box." When I asked what happened after that, she said, "I put a Band-Aid there." Both of these events occurred the Friday before the childs return home. COURSE: The patient was seen by SANE nurse. In the meantime, the childs complaints were reported to the Ellsworth Office of Child Protective Services.

There are 2 common aspects of abuser behavior in battered child syndrome. 1. 2. Perpetrators often delay seeking medical treatment for the victim. It is common for the abuser to offer false stories to account for the injuries.

Mila: I screamed at him. Lori: And then what happened? Mila: He put me right in my car seat. Buckled me. Lori: And then what happened? Mila: we went home. Lori: Did you find Bajkia? Mila: uhhh Lori: Was Bajkia lost? Mila: He was at the bakery?

Lori: and then he said what? That is when he said you had to go get Bajika? Mila: ahnahthats when he came in and smacked me.

Mila telling her mother her father told her it was just a birthmark within 45 minutes of seeing her mother for the first time in 24 days. Her father retained Mila as soon as DHHS began investigation. Her father claimed he had to keep Mila safe from these false reports of abuse.

Milas Extreme Weight Loss During 24 Days Igor retained Her


On 3/27 Ellsworth ER report for the contusion to the head she weighed 18 kg or 39.68 pounds. On 4/28 the Gtown ER report because she had the tummy bug she weighed 15.3 kg or 33.78 pounds.

12 May 2011 Boisvert, DHHS Supervisor Portland


12 May 2011-Louise Boisvert at DHHS claims because Mila didnt disclose in a neutral setting about the panthere is no evidence of abuse. Boisvert cannot and wont explain why her casework told Steve Pickering are you sure it wasnt the birthmark? and why Mila told me Poppa told her to tell me there was no bruisejust a birthmark. Boisvert says she stands by her caseworkers who do excellent work. I point out for 3 years Mila has been disclosing in neutral settingsall ignored by DHHS-including Spurwink. When Mila does disclose it is ignored. Boisvert says that Spurwink doesnt believe Mila was sexually abused. Boisvert also says the weight loss was probably due to Mila throwing up. DHHS will take no action on anything because Boisvert says DHHS position this is just a terrible custody problem where two parents cant get along and she hopes for that poor little girl I can learn to co-parent with Igor.

DHHS Case Worker Cummings Interviewed Igor Malenko & his lawyer Michael Waxman a full 24 hours before she interviewed Mila. This alone renders Milas interview completely null and void. DHHS Case Worker Cummings allowed her investigation, and the resulting no evidence of child abuse, to be completely dictated by Igor Malenkos account; which was there was no bruise. It was only a birthmark.

Dr. Jackie Campbells Lethality Assessment of Igor Malenko


Jacquelyn C. Campbell, PhD, RN, FAAN (Fellow of the American Academy of Nursing), Anna D. Wolf Chair and Professor, Johns Hopkins University School of Nursing Employment background: 27 years as a researcher and clinician in the area of domestic violence. Developed Danger Assessment as a lethality and near lethality risk assessment instrument for cases of domestic violence in 1986 with two major federally funded and five small validation studies conducted from 1987 2005. More than 150 refereed publications and 7 books published on domestic violence, domestic violence homicide and near homicide, and domestic violence risk assessment and lethality assessment. Twenty eight years as a Professor of nursing, teaching research and family violence to undergraduate, masters, doctoral and post doctoral students in nursing, public health and medicine as well as conducting trainings of judges, law enforcement, prosecutors, mediators, lawyers, child custody advocates, physicians, nurses, DV advocates and others in domestic violence homicide and domestic violence risk assessment. Elected member of the Institute of Medicine and the American Academy of Justice, recipient of the Vollmer Award, the American Society of Criminology Award for research contributing to justice.

I can say that I can predict with a 92% level of accuracy or confidence, that Ms. Handrahan is at extreme risk to be killed or almost killed by Mr. Malenko.
Since approximately 17% of intimate partner homicides of women also involve killing a child, Mila is also at risk to be killed if visitation is not supervised. In conclusion, in my expert opinion, based on findings from a validated assessment of danger in domestic violence cases, I strongly recommend only supervised visitation until the child reaches majority because of extreme danger to Ms. Handrahan from Mr. Malenkov, and by extension serious danger as well as serious risk of traumatic effects to the minor child, Mila.
