GAPS IN LAWS AND REGULATIONS

Presently, there is no legislation at central, state or local level that

comprehensively covers urban transport requirements of Indian
cities. For example, there are three Acts that are specific to metro
systems in India

Tramways Act, 1886, is for operation of trams on the road surface

within the municipal limits
Metro Railways (Construction of Works) Act, 1978, covers the
needs of construction of metro railways in metropolitan cities and
for matters connected therewith.
Delhi Metro Railway (Operation and Maintenance) Act, 2002,
provides for the operation and maintenance, and to regulate the
working of the metro railway in the metropolitan city of Delhi.
Earlier, Kolkata Metro had enacted a similar act for operation and
maintenance of Kolkata Metro as an adjunct to the Indian Railway
Act.

DAMEPL
19.2 kms extended to 23 kms

Four to six stations

30 year BOT

Depot shifted to Dwarka Sector 21

REL/RInfra won the bid with concession fee of Rs 51

crore per year of operation with 5% annual escalation

Total project cost was Rs 5800 crore with RInfra

contributing Rs 2885 crore
DAMEPL
In February 2012, problems in the AEL first emerged

On July 8, 2012 the service was stopped indefinitely

As on October 1, 2012, DMRC was working on the

AEL
Options before RInfra

RInfra was losing close to Rs 1 cr a day on the AEL

After the inspection, it was expected the speed would be

decreased from 120 kmph to 50 kmph, thereby
increasing in travelling time from 18 min to 40 min

Due to this increase in time, its advantage over auto and

taxis would reduce thereby decreasing the number of
passengers using this service
Options before RInfra

Taking various aspects into consideration, RInfra had

following options:

1. Pull out from operating services claiming

compensation from DMRC

2. Reopen services on the AEL, claiming penalty on

DMRC

3. Reopen services, claiming no penalty on DMRC:

Recent Updates

1. October 2012 Rinfra decided to pull out

2. November 2012 dispute referred to arbitration tribunal

3. July 2013 DMRC took over operation and maintenance

of the line

4. May 11, 2017 after 68 hearing for about three years,

Rinfra has been awarded total compensation including
the interest of Rs 1775 crore is Rs 4725, possibly the
largest arbitration award
