INTERVENTIONS AND LEGISLATIVE PROVISIONS INCLUDING NDPS ACT-1985 NDPS ACT 1985 In view of the danger of the drug to the society and due to free availability , an urgent need was felt for enactment of comprehensive legislation on Narcotic Drugs and Psychotropic substances as the existing laws found to be inadequate. The NDPS ACT 1985 came into effect on 14-11-1985. This act is having interventional spirit to cancel, control, regulate and availability of Narcotic Drugs and Psychotropic Substances for purposely. Medicinal use and scientific research and to take straight action or punishment against violations of the law

Sec 53 Sub (1): Powers to the Central Government Departments: •Central Excise •Narcotics, Customs •Revenue Intelligence •Para-Military Forces Sub Sec (2): State Government Officers: •Drugs Control Department •Police •Revenue •Excise Act is having 6 Chapters with 83 Sections Chapter - III deals with prohibition, control and regulation Chapter - IV deals with penalties Chapter - V deals procedure how to research, seize, arrest duly following mandatory provisions •Provision under Sec 42, 48, 50, 52 & 57 are mandatory. While detecting the case the above provisions under above sections shall be followed strictly otherwise it vitiates the trail.
•Chapter V A having Sec 68(A) to 68(Z)
