Disability Pension Scheme in

KOSOVO

 INTRODUCTION
The Kosovo Social Protection System is in a very early stage of development.
At this point in time, legal infrastructure regarding social security is being
created by institutions in order to create a more comprehensive social
protection system. Several laws have been promulgated by the Kosovo, several other
laws are in different stages of the adaptation process.
It is important however, that all legislation adopted in Kosovo is very modern,
democratic and conform to main international documents and treaties.

 PENSIONS SYSTEM IN THE REPUBLIC OF
KOSOVO

After the war in Kosovo, particularly from 01. july .2002 begins to be
applied the reformed pension system based on three Pillars.

• FIRST PILLAR:
Basic pensions, and other special schemes, funded from the state budget
revenues,

• THE SECOND PILLAR:

is mandatory pension savings of 5% and 5% employer.

• THIRD PILLAR:
Supplementary voluntary (fulfill the first and second pillar ) Private
Voluntary Pension organized on an individual basis or by enterprises
themselves - stimulated by the state to tax relief.

 PENSION SCHEME OF PEOPLE WITH DISABILITIES

 In Kosovo this category is treated in the first pillar pension system, and is funded
by the state budget.
 aims to care by the state for financial assistance to persons which are permanent
physical disability, mental and psychological and incapable of any type of work.

 LEGAL
 Law no. 2003/23 dated 06.11.2003, treats people with disabilities aged from
18 to 65 years, applicable from 01.01.2004

Law no. 03/L-22 for the care of materials Families with disabled children
from 1-18 years old (from birth to 18 years).
Scheme of Persons with Disabilities (children aged 1-18 years.)

Families with Disabled children is a new scheme which

started at beginning of the year (2009), and it will cover a category of
people with permanent disabilities who until now have not had good care
and materials from the State. 
Beneficiaries of this scheme will be families who care for children with
permanent disabilities aged from 0 to 18 years .
This includes several categories, blind people, children with physical
problems, and children who can not meet their physiological needs and are
in need 24 hours care. The monthly benefit is 100 euro`s per child.

 Disability pension

 means a benefit - a pension that is paid to persons with disabilities, and

managed by the Ministry of Labour and Social Welfare.
 Financial support to persons which are totally and Permanently Disabilities, and
incapable of any type of work.

 THE MEDICAL-EXAMINATION PROCEDURES

 Medical Committee means - a group compound by medical

experts specialized in the field of medicine appointed by the
Respective Institution
THE MEDICAL COMPOUND OF THE COMMISSION

 At least three specialist physicians from related fields, the

chairman and at least two members.
 The medical compound of commissions appointed by the
particular specialist field and application depending on
which subjects examined.
COMMISSION OF FIRST LEVEL

 It is responsible for examining, assessing and determining

the condition of Physical Disability, mental and psychical of
applicant

 THE RIGHT TO APPEAL

 The party dissatisfied with the decision of first instance based

on legal dispositions is entitled to appeal in the second level.

MEDICAL COMMISSION OF SECOND LEVEL

 In accordance with the dispositions for disability pension, is

competent and responsible for deployment eligibility under
the complaints that were rejected by the medical
commission of first Level .
 A member of a medical commission of first level (instance)
may not be member of second Level (instance).
 The party dissatisfied with the decision of second Level
(instance) of the respective institution, has the right to
made request the competent court (Supreme Court)

 REVALUATION

 Based on the disposition of Law 2003/23, the Commission

of medical experts will determine permanent and fully
disability physical and mental sets a deadline of
revaluation. Beneficiary of the disability pension must
undergo medical reevaluation committee after 1 year, 3
years and maximum 5 years.

 REVALUATION: means review procedures of the commission

examination by medical experts, where the right to
disability pension may be terminated or extended
depending on the health situation during the reassessment

Additional INFORMATION
• civil service regulation no. 2001/36 prohibits discrimination on the basis of
disability
• basic rules on labor law no 221/27 any kind prevents
discrimination against a disabled person as a result of mental and physical defects
